المادة 6- يكون الإيجاب والقبول في الزواج بالألفاظ التي تفيد معناه لغة أو عرفاً .
الألفاظ التي ينعقد بها الزواج:
يتفق الفقهاء على أن الزواج ينعقد بلفظ الإنكاح والتزويج، وهما اللفظان الصريحان في عقد الزواج([1] .
واقتصر الشافعية والحنابلة على ذلك([2] : فلا ينعقد عندهم الزواج بغير هذين اللفظين، قالوا: لأن نص الكتاب ورد بهما، وذلك في قوله تعالى: {وَلاَ تَنْكِحُوا مَا نَكَحَ آَبَاؤُكُمْ مِنَ النِّسَاءِ إِلاَّ مَا قَدْ سَلَفَ} [النساء: 22]، وقوله تعالى: {فَلَمَّا قَضَى زَيْدٌ مِنْهَا وَطَرًا زَوَّجْنَاكَهَا} [الأحزاب: 37]، ولم يذكر سواهما في القرآن الكريم، فوجب الوقوف معهما تعبداً واحتياطاً.
أما الحنفية والمالكية([3] : فقد أجازوا عقد الزواج بما يدل عليه؛ ولو كناية في الجملة.
