مطلب: طهارة الحيوان الميت ونجاسته:
أ - ميتة ما ليس له نَفْس سائلة:
ب - ميتة الحيوان المائي:
العمدة في الاستدلال بحل ميتة الحيوان البحري، قوله صلى الله عليه وسلم: "هُوَ الطَّهُورُ مَاؤُهُ، الْحِل مَيْتَتُهُ"([1] ) .
ذهب الحنفية إلى أن ما كان مائي المولد من الحيوان فموته في الماء لا يفسده؛ كالسمك، وما يُلحق به.
والحديث يفيد عدم تنجس الحيوان البحري بالموت، وإذا لم يكن نجساً لا ينجس ما يجاوره. وكذا لو مات خارج الماء ثم وقع فيه([2] ) .
وعند المالكية: دواب الماء طاهرة، سواءٌ مات الحيوان المائي حتف أنفه ووجد طافياً، أو بسبب شيء فُعِل به، من اصطياد، أو وُجِد في بطن حوتٍ([3] ) .
وعند الشافعية: ميتة حيوان البحر طاهرة وحلال أكلها، وما يعيش في الماء، وفي البر كطير الماء مثل: البط، والإوز، ونحوهما فحلال، إلا ميتتها لا تحل قطعا، والضفدع والسرطان محرمان على المشهور، وذوات السموم حرام قطعاً، ويحرم التمساح على الصحيح، والسلحفاة على الأصح([4] ) .
وذهب الحنابلة إلى أنه: تباح ميتة السمك وسائر حيوان البحر الذي لا يعيش إلا في الماء فهو طاهر حياً وميتاً، ولولا ذلك لم يبح أكله، وحيوان البحر الذي يعيش في البر كالضفدع والتمساح وشبههما يَنْجُسُ بالموت، فَيُنَجِّسُ الماء القليل إذا مات فيه، والكثير إذا غَيَّرَهُ (في اللون، أو الطعم، أو الرائحة)([5] ) .
