الكفاءة
المادة 26 - يشترط في لزوم الزواج أن يكون الرجل كفؤاً للمرأة.
ه - السلامة من العيوب:
ذهب المالكية والشافعية وابن عقيل من الحنابلة، إلى أنّ السلامة من العيوب المُثْبِتَةِ لخيار فسخ النّكاح من خصال الكفاءة في النّكاح.
وقال ابن رشد من المالكية: المراد أن يساويها في الصّحة، أي: أن يكون سالماً من العيوب الفاحشة([1] .
وفصَّل الشافعية فقالوا: من الخصال المعتبرة في الكفاءة السلامة من العيوب المُثْبِتَةِ للخيار، فمَن به بعضُها؛ كالجنون، أو الجذام، أو البرص، لا يكون كفئاً لسليمة عنها؛ لأنّ النفس تعاف صحبة مَن به ذلك، ويَخْتَلُّ به مقصود النّكاح، ولو كان بها عيب أيضاً، فإن اختلف العيبان فلا كفاءة، وإن اختلفا وما به أكثر فكذلك، وكذا إن تساويا، أو كان ما بها أكثر في الأصحّ؛ لأنّ الإنسان يَعاف مِن غيره ما لا يَعاف مِن نفسه، وكذا لو كان مجبوباً [مقطوع الذكر] وهي رتقاء أو قرناء [الرتق وهو انسداد محل الجماع بلحم، والقَرَن وهو انسداد محل الجماع بعَظْم].
واستثنى البغويّ الْعُنَّةُ [داء يمنع انتشار الذكر وانتصابه] لعدم تحقّقها، فلا نظر إليها في الكفاءة، قال الشيخان [الرافعي والنووي]: التسوية بينها وبين غيرها، وإطلاق الجمهور يوافقه، قال الشّربينيّ الخطيب: وهذا هو المعتمد، ووُجِّهَ بأنّ الأحكام تبنى على الظاهر ولا تتوقف على التحقّق.
وألحق الرّويانيّ بالعيوب الخمسة العيوبَ المنفّرة؛ كالعمى، والقطع [لبعض الأطراف]، وتشوّه الصّورة.
واشتراط السلامة من هذه العيوب هو على عمومه بالنّسبة إلى المرأة، أما بالنّسبة إلى الوليّ، فيعتبر في حقّه الجنون والجذام والبرص، لا الجَبّ والعُنّة.
وقال القاضي [حُسين بن محمد بن أحمد المرورّوزي]: يؤثّر في الزوج كلّ ما يكسر سورة التوقان([2] .
وقال المقدسيّ من الحنابلة: ويتجه أنّه مما ينبغي اشتراطه في الكفاءة فقد العيوب المُثْبِتَةِ لخيار الفسخ، قال الشيخ تقيّ الدّين: وقد أومأ إليه أحمد: أنّها لا تُزَوَّج بمعيب وإن أرادت، فعلى هذا فإن السلامة من العيوب من جملة خصال الكفاءة([3] .
وقال الحنفية وأكثر الحنابلة: لا تعتبر في الكفاءة السلامة من العيوب([4] ، لكنّ ابن عابدين نقل عن الفتاوى الحامدية، أنّ غير الأب والجدّ من الأولياء لو زوج الصغيرة من عنّين معروف لم يجز؛ لأنّ القدرة على الجماع شرط الكفاءة؛ كالقدرة على المهر والنفقة، بل أولى، ونقل عن البحر أنّ الكبيرة لو زَوَّجَهَا الوكيل غنيّاً مجبوباً جاز، وإن كان لها التفريق بَعْدُ([5] .
