المادة 26 - يشترط في لزوم الزواج أن يكون الرجل كفؤاً للمرأة.
تخلّف الكفاءة فيمن رضي به الأولياء في نكاح سابق:
ذهب الحنفية إلى أنّ الولي لو زَوَّجَ المرأة بإذنها من غير كفء فطلقها، ثم زوجت نفسها منه ثانياً، كان لذلك الوليّ التفريق، ولا يكون الرّضا بالأول رضاً بالثاني؛ لأنّ الإنسان لا يبعد رجوعه عن خلة دنيئة، وكذا لو زَوَّجَها هو من غير كفء فطلقها فتزوجت آخر غير كفء، ولو تزوجته ثانياً في العدة؛ فَفَرَّقّ بينهما لزمه مهر ثان، واستأنفت العدة، وإن كان قبل الدّخول في الثاني([1] .
وقال المالكية: ليس لوليّ رضي بتزويج وليته غير كفء، وزَوَّجَه إياها، فطَلَّقَها طلاقاً بائناً أو رجعيّاً، امتناع من تزويجها له ثانياً - إن رضيت به - بلا عيب حادث مقتض للامتناع؛، لسقوط حقّه في الكفاءة، حيث رضي به أولاً؛ فإن امتنع عُدَّ عاضلاً، وله الامتناع بعيب حادث([2] .
وقال الشافعية: لو رضي الأولياء بتزويجها بغير كفء، ثم خالعها الزوج، ثم زَوَّجَها أحد الأولياء به برضاها دون رضا الباقين: فإنّه يصحّ؛ لرضاهم به أولاً، وفي معنى المختلع: الفاسخُ والمطلِّق رجعيّاً إذا أعاد زوجته بعد البينونة، والمطلِّق قبل الدّخول([3] .
