الحرمات المؤبدة
المادة 34 - يحرم على الرجل:
1- زوجة أصله أو فرعه وموطوءة أحدهما
2- أصل موطوءته وفرعها وأصل زوجته.
مُحَرَّمات النّكاح
المحرّمات من النّساء نوعان:
أ - محرّمات على التّأبيد.
ب - محرّمات على التّأقيت.
أوّلاً: المحرّمات تحريماً مؤبّداً:
أسباب تأبيد حرمة التّزوج بالنّساء ثلاثة، هي:
أ - القرابة.
ب - المصاهرة.
ج - الرّضاع.
أ - المحرّمات بسبب القرابة:
ب - المحرّمات بسبب المصاهرة
يحرم بالمصاهرة أربعة أنواعٍ:
يرى الحنفيّة أنّ من زنى بامرأة أو لمسها، أو قبّلها بشهوة أو نظر إلى فرجها بشهوة: حرم عليه أصولها، وفروعها، وتحرّم المرأة على أصوله وفروعه؛ لأنّ حرمة المصاهرة تثبت عندهم بالزّنا ومقدّماته، ولا تحرّم أصولها ولا فروعها على ابن الزّاني وأبيه.
وتعتبر الشّهوة عندهم عند المسّ والنّظر، حتّى لو وجدا بغير شهوةٍ ثمّ اشتهى بعد التّرك لا تتعلّق به الحرمة.
وحد الشّهوة في الرّجل أن تنتشر آلته، أو تزداد انتشاراً إن كانت منتشرةً([1] .
وعند الحنابلة يكون التّحريم بالزّنا دون المقدّمات.
ومناط التّحريم عند الحنفيّة والحنابلة: الوطء، حلالاً كان أو حراماً.
فلو زنى رجل بأمّ زوجته، أو بنتها: حرمت عليه زوجته حرمةً مؤبّدةً، ويجب عليهما أن يفترقا من تلقاء نفسيهما؛ وإلا فرّق القاضي بينهما([2] .
ولم يفرّق الحنفيّة والحنابلة بين حصول الزّنا قبل الزّواج أو بعده في ثبوت حرمة المصاهرة.
وذهب مالك في قوله الرّاجح، والشّافعي إلى أنّ الزّنا لا تثبت به حرمة المصاهرة؛ فلا تحرّم بالزّنا عندهما أصول المزنيّ بها، ولا فروعها على من زنى بها، كما لا تحرّم المزني بها على أصول الزّاني، ولا على فروعه.
فلو زنى رجل بأمّ زوجته أو ابنتها لا تحرّم عليه زوجته، وأنّ حرمة المصاهرة نعمة؛ لأنّها تلحق الأجانب بالأقارب، والزّنا محظور، فلا يصلح أن يكون سبباً للنّعمة، لعدم الملاءمة بينهما([3] .
