الحرمات المؤبدة
المادة 34 - يحرم على الرجل:
1- زوجة أصله أو فرعه وموطوءة أحدهما
2- أصل موطوءته وفرعها وأصل زوجته.
مُحَرَّمات النّكاح
المحرّمات من النّساء نوعان:
أ - محرّمات على التّأبيد.
ب - محرّمات على التّأقيت.
أوّلاً: المحرّمات تحريماً مؤبّداً:
أسباب تأبيد حرمة التّزوج بالنّساء ثلاثة، هي:
أ - القرابة.
ب - المصاهرة.
ج - الرّضاع.
أ - المحرّمات بسبب القرابة:
ب - المحرّمات بسبب المصاهرة
يحرم بالمصاهرة أربعة أنواعٍ:
3) فروع الزّوجة، وهنّ بناتها، وبنات بناتها، وبنات أبنائها وإن نزلن؛ لأنّهنّ من بناتها بشرط الدخول بالزّوجة، وإذا لم يدخل فلا تحرّم عليه فروعها بمجرّد العقد.
فلو طلّقها أو ماتت عنه قبل الدخول بها، فله أن يتزوّج بنتها، وهذا معنى قول الفقهاء: الدخول بالأمّهات يحرّم البنات؛ لقوله تعالى في آية المحرّمات: {وَرَبَائِبُكُمُ اللَّاتِي فِي حُجُورِكُمْ مِنْ نِسَائِكُمُ اللَّاتِي دَخَلْتُمْ بِهِنَّ فَإِنْ لَمْ تَكُونُوا دَخَلْتُمْ بِهِنَّ فَلَا جُنَاحَ عَلَيْكُمْ} [النساء: 23]، وذلك عطف على قوله تعالى: {حُرِّمَتْ عَلَيْكُمْ أُمَّهَاتُكُمْ وَبَنَاتُكُمْ} [النساء: 23]، فيكون المعنى تحريم التّزوج بالرّبائب اللّاتي في حجوركم من نسائكم اللّاتي دخلتم بهنّ.
والرّبائب جمع ربيبةٍ، وربيب الرّجل، ولد امرأته من غيره، سمّي ربيباً له، لأنّه يَرُبُّهُ أي: يَسُوسُهُ، والرّبيبة ابنة الزّوجة، وهي حرام على زوج أمّها بنصّ الآية، سواء أكانت في الحجر، أم لم تكن، وهي تحظى بما تحظى به البنت الصلبيّة من عطفٍ ورعايةٍ.
وأمّا تحريم بنات الرّبيبة وبنات الرّبيب فثابت بالإجماع.
ووصف الرّبيبة بأنّها في الحجر ليس للتّقييد، بل خرج مخرج الغالب؛ لبيان قبح التّزوج بها، لأنّها غالباً تتربّى في حجره؛ كابنه، وابنته، فلها ما لبنته من تحريمٍ.
