الحرمات المؤقتة
المادة 36
1 - لا يجوز أن يتزوج الرجل امرأة طلَّقها ثلاث مرات إلا بعد انقضاء عدتها من زوج آخر دخل بها فعلاً.
2 - زواج المطلَّقة من آخر، يهدم طلقات الزوج السابق؛ ولو كانت دون الثلاث، فإذا عادت إليه يملك عليها ثلاثاً جديدة.
مُحَرَّمات النّكاح
المحرّمات من النّساء نوعان:
أوّلاً: المحرّمات تحريماً مؤبّداً
ثانياً: المحرّمات تحريماً مؤقّتاً:
التّحريم على التّأقيت يكون في الأحوال الآتية:
الأوّل: زوجة الغير ومعتدّته
ويترتّب على نكاح المعتدّة من الغير آثار منها:
أ - التّفريق بينهما
نكاح معتدّة الغير يعتبر من الأنكحة الفاسدة المتّفق على فسادها، ويجب التّفريق بينهما، وهذا باتّفاق([1] .
وقد روى سعيد بن المسيّب وسليمان بن يسارٍ أنّ طليحة كانت تحت رشيدٍ الثّقفيّ فطلّقها فَنَكَحَتْ في عدّتها، فضربها عمر رضي الله عنه، وضرب زوجها بِمِخْفَقَةٍ ضرباتٍ ثمّ قال: أيما امرأةٍ نَكَحَتْ في عدّتها؛ فإن كان زوجها الّذي تزوّجها لم يدخل بها: فُرِّقَ بينهما، ثمّ اعتدّت بقيّة عدّتها من زوجها الأوّل، وكان خاطباً من الْخُطَّابِ، وإن كان دخل بها: فُرِّقَ بينهما، ثمّ اعتدّت بقيّة عدّتها من زوجها الأوّل، ثمّ اعتدّت من الآخر ولم يَنْكِحْهَا أبداً.
