المادة 36
1 - لا يجوز أن يتزوج الرجل امرأة طلَّقها ثلاث مرات إلا بعد انقضاء عدتها من زوج آخر دخل بها فعلاً.
2 - زواج المطلَّقة من آخر، يهدم طلقات الزوج السابق؛ ولو كانت دون الثلاث، فإذا عادت إليه يملك عليها ثلاثاً جديدة.
مُحَرَّمات النّكاح
المحرّمات من النّساء نوعان:
أوّلاً: المحرّمات تحريماً مؤبّداً
ثانياً: المحرّمات تحريماً مؤقّتاً:
التّحريم على التّأقيت يكون في الأحوال الآتية:
الأوّل: زوجة الغير ومعتدّته
الثّاني: التّزوج بالزّانية
الثّالث: المطلّقة ثلاثاً بالنّسبة لمن طلّقها:
يحرم على المسلم أن يتزوّج امرأةً طلّقها ثلاث تطليقاتٍ؛ لأنّه استنفد ما يملكه من عدد طلقاتها، وبانت منه بينونةً كبرى، وصارت لا تحل له إلا إذا انقضت عدّتها منه، ثمّ تزوّجها زوج آخر زواجاً صحيحاً، ودخل بها حقيقةً، ثمّ فارقها هذا الآخر وانقضت عدّتها منه، لقوله تعالى : {الطَّلَاقُ مَرَّتَانِ فَإِمْسَاكٌ بِمَعْرُوفٍ أَوْ تَسْرِيحٌ بِإِحْسَانٍ} [البقرة: 229]، ثمّ قال سبحانه وتعالى : {فَإِنْ طَلَّقَهَا فَلَا تَحِلُّ لَهُ مِنْ بَعْدُ حَتَّى تَنْكِحَ زَوْجًا غَيْرَهُ فَإِنْ طَلَّقَهَا فَلَا جُنَاحَ عَلَيْهِمَا أَنْ يَتَرَاجَعَا إِنْ ظَنَّا أَنْ يُقِيمَا حُدُودَ اللَّهِ وَتِلْكَ حُدُودُ اللَّهِ يُبَيِّنُهَا لِقَوْمٍ يَعْلَمُونَ} [البقرة: 230].
وبيّنت السنّة النّبويّة أنّ الزّواج الثّاني لا يُحِلُّهَا للأوّل إلا إذا دخل بها الزّوج الثّاني دخولاً حقيقياً، وكان الزّواج غير مؤقّتٍ، وانتهت العدّة بعد الدخول([1] .
فقد جاء عَنْ عَائِشَةَ رَضِيَ اللَّهُ عَنْهَا: جَاءَتْ امْرَأَةُ رِفاعَةَ الْقُرَظِيِّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، فَقَالَتْ: كُنْتُ عِنْدَ رِفَاعَةَ فَطَلَّقَنِي، فَأَبَتَّ طَلَاقِي، فَتَزَوَّجْتُ عَبْدَ الرَّحْمَنِ بْنَ الزَّبِيرِ، إِنَّمَا مَعَهُ مِثْلُ هُدْبَةِ الثَّوْبِ، فَقَالَ: "أَتُرِيدِينَ أَنْ تَرْجِعِي إِلَى رِفَاعَةَ؟ لَا، حَتَّى تَذُوقِي عُسَيْلَتَهُ، وَيَذُوقَ عُسَيْلَتَكِ"([2] .
