الحرمات المؤقتة
المادة 36
1 - لا يجوز أن يتزوج الرجل امرأة طلَّقها ثلاث مرات إلا بعد انقضاء عدتها من زوج آخر دخل بها فعلاً.
2 - زواج المطلَّقة من آخر، يهدم طلقات الزوج السابق؛ ولو كانت دون الثلاث، فإذا عادت إليه يملك عليها ثلاثاً جديدة.
المادة 37 - لا يجوز أن يتزوج الرجل خامسة حتى يطلق إحدى زوجاته الأربع وتنقضي عدتها.
المادة 38 - لا يجوز التزوج بزوجة آخر ولا بمعتدته.
مُحَرَّمات النّكاح
المحرّمات من النّساء نوعان:
أوّلاً: المحرّمات تحريماً مؤبّداً
ثانياً: المحرّمات تحريماً مؤقّتاً:
التّحريم على التّأقيت يكون في الأحوال الآتية:
الأوّل: زوجة الغير ومعتدّته
الثّاني: التّزوج بالزّانية
الثّالث: المطلّقة ثلاثاً بالنّسبة لمن طلّقها
الرّابع: المرأة الّتي لا تدين بدين سماويٍّ
الخامس: التّزوج بالمرتدّة:
المرتدّة: مَن رجعت عن دين الإسلام اختياراً دون إكراهٍ على تركه، ولا تَقِرُّ على الدّين الّذي اعتنقته، ولو كان ديناً سماوياً.
يرى الحنفيّة أنّه لا يجوز نكاح المرتدّة؛ لا بمسلم، ولا بكافر غير مرتدٍّ؛ لأنّ المرتدّة تركت الإسلام، فتكون الرّدّة في معنى الموت، والميّت لا يكون محلاً للنّكاح([1] .
ويرى المالكيّة عَدَمَ جواز نكاح المرتدّة، كما قالوا بفسخ النّكاح إذا ارتدّ أحد الزّوجين، ويكون الفسخ بطلقة بائنةٍ؛ وإن رجعت المرتدّة إلى الإسلام([2] .
وأمّا الشّافعيّة فقالوا: إنّ المرتدّة لا تحل لأحد، لا لمسلم؛ لأنّها كافرة لا تَقِرُّ، ولا لكافر أصليٍّ لبقاء عُلْقَةِ الإسلام، ولا لمرتدّ؛ لأنّ القصد من النّكاح الدّوام، والمرتد لا دوام له([3] .
وذهب الحنابلة إلى أنّ المرتدّة لا يحل نكاحها حتّى تعود إلى الإسلام؛ لأنّ النّكاح ينفسخ بالرّدّة، وَيَمْتَنِعُ استمراره، فأولى أن يَمْتَنِعَ ابتداءً([4] .
