للفقهاء في حكم مسح الرقبة ثلاثة أقوال([1] ) :
فقال الحنفية وأحمد في رواية: من مستحبات الوضوء مسح المتوضئ رقبته بظهر يديه، قال ابن عابدين: هذا هو الصحيح. وقيل: إنه سنة.
وقال المالكية والشافعية والحنابلة في الصحيح من المذهب: لا يسن مسح الرقبة؛ إذ لم يثبت فيه شيء.
وقال المالكية: لا يندب مسح الرقبة بالماء؛ لعدم ورود ذلك في وضوئه صلى الله عليه وسلم، بل يكره؛ لأنه من الغلو في الدين.
