الحكمة من مشروعية المناقصة
تبرز أهمية عقد المناقصة والحكمة من مشروعيته من خلال النقاط التالية:
1 ـ يمكن الحصول بعقد المناقصة على أكبر منفعة بأقل تكلفة، وقد أشارت الشريعة على ذلك بقوله تعالى {وَالَّذِينَ إِذَا أَنْفَقُوا لَمْ يُسْرِفُوا وَلَمْ يَقْتُرُوا وَكَانَ بَيْنَ ذَلِكَ قَوَامًا} [الفرقان: 67]، ولا شك أن المناقصة توازن هذا الإنفاق، وتحقق المنفعة بأقل تكلفة مما يساهم في الوفر المالي.
2 ـ إن عقود المناقصات تشكل وسائل رقابة على النفقات العامة التي تقوم بها الدولة؛ حتى لا تسيء استخدام الأموال العامة، مما يؤدي إلى حفظ المال العام من العبث والإهدار.
3 ـ عقود المناقصات تهدف إلى تحقيق المصلحة العامة أو الخاصة بأقل التكاليف، مع دفع التهمة عمن يباشرها، خاصة إذا تعلق الأمر بالأموال العامة، أو أموال اليتامى؛ ولذلك قد تتعيّن المناقصات في الشراء، أو إنجاز العمل لمؤسسات الدولة العامة مثل إنشاء المدارس، والأوقاف، أو المتعلقة بأموال اليتامى.
4 ـ تشكل المناقصات حاجة للدولة ومؤسساتها، وللشركات الخاصة الصناعية، وللأفراد أيضاً؛ إذ تسعى إلى ضمان تنفيذ مشاريعها على الوجه المطلوب، وفي الوقت المحدد بما لا يفوت حصول المصلحة وفق أفضل الشروط وأدنى الأسعار.
