الغرر
النهي عن الغرر
جاء في صحيح مسلم من حديث أبي هريرة رضي الله عنه قال: نهى رسول الله عن بيع الحَصاة وعن بيع الغرر.
أخبرنا أبو هريرة أنّ نبيّنا نهانا عن بيع الغرر، نهانا عن البيع المشتمِل على الغرر، وهذا الغرر المنهيّ عنه سواء في جانب البائع أو جانب المشتري، فكلٌّ منهما منهيّ عن بيع الغرَر حتّى ولو رضي أحدٌ بذلك، فالغرر الضارّ لا يُقرُّ في الإسلام، وليس تراضي المتبايعَين بمبيحٍ لهما ما حرَّم الله عليهما.
الغررُ الذي نهى عنه يعود إلى جهلِ البائع أحيانًا بعَين ما باع، أو جهلِ المشتري بعَين ما اشترى، ويعود تارةً أخرى إلى آجالٍ مجهولة لا يُعلَم انتهاؤها، وكلّ ذلك أمرٌ محرّم.
وقد جاء في السنّة النّهيُ عن بيوعٍ تشتمل على الخِداع والغرَر؛ لأنّ في هذا غشًّا وإن رضيَ به أحدهما أو رضيا به جميعًا، فليس الرّضا بمبيح لهما ارتكابَ ما حرّم الله عليهما.
لهذا شرط العلماءُ في البَيع علمَ المشتري بحقيقةِ ما اشتراه، وعلمَ البائع بحقيقة الثّمن، وعلمَهما بقدر الأجل المضروبِ لهما، كلُّ ذلك حمايةً من أن يأكلَ النّاس بعضهم مالَ بعض ظلمًا وعدوانًا.
لقد كانوا في الجاهليّة يتبايَعون بيوعًا فيها خِداع، الغنيمةُ لأحدهما والغُرم على الآخر، عقودُ بيع يكون أحدُ المتبايعَين غانمًا، ويكون أحدهما غارمًا؛ لأنّها مبنيّة على المغامرة والجهالةِ وعدم العلم، فجاء الإسلام فألغى ذلك كلَّه.
