ثانياً: حكم إلحاق القراءة من الجوال بالقراءة من المصحف:
هل القراءة من الجوال في الصلاة تُلحق بالقراءة من المصحف؟! أم هي مختلفة فلا تلحق بها؟
هناك رأيان:
الرأي الأول: أنها تلحق بالقراءة من المصحف. وحجتهم أن الجوال وسيلة لعرض نص المصحف؛ فلا يختلف عن المصحف الورقي.
الرأي الآخر: أنها لا تلحق بالقراءة من المصحف. وحجتهم أن المنصوص عليه في الفقه هو حمل المصحف في الصلاة؛ حيث إن له خصوصية ليست موجودة في غيره، كما إن بعض الفقهاء كرهوا حمل المصحف والقراءة منه أثناء الصلاة لاحتياج حمله إلى نوع من الحركة، والجوال يحتاج إلى مثل ذلك في الحركة.
بالنظر الفقهي الدقيق للمسألة نقول:
إذا كانت القراءة من المصحف الالكتروني (شاشة الجوال) لا إشكال فيها خارج الصلاة، فما الذي يمنع منها أثناء الصلاة؟! وعلى هذا فالأصل الإباحة في هذه المسألة، وعلى من يمنع أن يأتي بالدليل.
ولا يُقال: الأصل المنع؛ بحجة أن الأصل في العبادات الحظر والمنع؛ لأننا نقول: إن وسائل العبادات ليست هي العبادات، ولا يصح إجراء مثل هذه القاعدة عليها، بل الوسائل تبقى على أصل الإباحة حتى يظهر فيها محظور شرعي.
ولو قيل بإلحاق وسائل العبادات بها في أن الأصل فيها الحظر لزم على ذلك لوازم كثيرة لا يمكن القول بها، ولا يقول بها المخالف أبداً، فالوسائل الصوتية (مكبرات الصوت وغيرها) على هذا ستُمْنَع في الصلاة والأذان، وكذلك الخط لتسوية الصفوف، والمساجد نفسها على هذه الهيئة الجديدة لم تكن على عهد النبي صلى الله عليه وسلم. وكذا سائر العبادات كالحج في أصله وشعائره كالطواف والسعي؛ إذ كثير منها يتم بوسائل مستحدثة.
مناقشة القول بالمنع لعلة الحركة في الصلاة:
ليس هناك فرق بين الجوال وغيره في وجود الحركة أثناء الصلاة بمعنى أن الحركة الكثيرة ممنوعة أثناء الصلاة بأي سبب كانت، ولا يختص ذلك بالجوال. ولذا فمن استخدم المصحف مع كثرة الحركة فقد أخل بالصلاة.
وكذلك الحال في الجوال فقد تصاحبه حركة كثيرة، وقد يستطيع المصلي أن يقرأ منه بحركة يسيرة تشبه حركة فتح المصحف ورده إلى المحمل عند السجود.
والحكم ينبغي دائماً أن يُسلّط على المسألة ذاتها دون ما قد يُحْتَفُّ بها من خارجها.
فائدة: لا خصوصية للمصحف الورقي، فكل ما كُتب فيه كلام الله تعالى يُغَدُّ مصحفاً، فقد يُكتب على جلد وعظام كما كان في عهد النبي صلى الله عليه وسلم، وقد يُكتب على الأوراق بأنواعها، وكذلك المداد (الحِبر) وطريقة الكتابة، تغيرت وتطوّرت من الحبر القديم وكتابة اليد إلى أنواع من أحبار المطابع وطباعتها وتصويرها.
وتطوّر الأمر إلى أن أصبح القرآن تَظْهَر رسوم أصوات قراءته على شاشة ضوئية (جوال أو نحوه).
