المبحث الأول: صَلاَةُ المَرِيض

القيام ركن في الصلاة المفروضة([1] .
قال الله تعالى: {وَقُومُوا لِلَّهِ قَانِتِينَ} [البقرة: 238].
وعن عِمْرَانَ بْنِ حُصَيْنٍ، أنه قال: كانت بي بواسير، فسألت رسول الله صلى الله عليه وسلم فقال: "صَل قَائِمًا، فَإِنْ لَمْ تَسْتَطِعْ فَقَاعِدًا، فَإِنْ لَمْ تَسْتَطِعْ فَعَلَى جَنْبِكَ"([2] .
فإن عجز المكلف عن القيام للصلاة، صلى قاعداً؛ للحديث المذكور؛ ولأن الطاعة بحسب الطاقة.
فإن صلى مع الإمام قائماً بعض الصلاة، وفتر (تعب) في بعضها؛ فصلى جالساً: صحت صلاته([3] .
ومن صلى قاعداً يركع ويسجد، ثم برئ (شُفِي، شعر بنشاط وقدرة على القيام)؛ بنى على صلاته قائماً عند الحنفية، والحنابلة([4] .
وجاز عند المالكية([5] أن يقوم ببعض الصلاة، ثم يصلي على قدر طاقته، ثم يرجع فيقوم ببعضها الآخر.
وكذلك الجلوس إن تقوس ظهره حتى صار كأنه راكع، رفع رأسه في موضع القيام على قدر طاقته([6] .
