المبحث الثاني: صلاة المسافر
أنواع الوطن بالمفهوم الشرعي:
للوطن أنواع: وطن أصلي، ووطن إقامة، ووطن سكنى.
الوطن الأصلي:
هو المكان الذي يستقر فيه الإنسان بأهله، سواء أكان موطن ولادته أم بلدة أخرى، اتخذها داراً، وتوطن بها مع أهله، وولده، ولا يَقصد الارتحال عنها، بل يقصد التعيش بها.
ويأخذ حكم الوطن الأصلي: المكان الّذي تأهّل (تزوّج) به.
ولا يحتاج الوطن الأصليّ إلى نيّة الإقامة.
فالوطن الأصليّ يتحقّق بالإقامة الدّائمة على نيّة التّأبيد، سواء أكان في مكان ولادته، أم في مكان آخر، ويلحق بذلك مكان الزّوجة([1] .
والوطن الأصليّ يجوز أن يكون واحداً أو أكثر، وذلك مثل أن يكون له أهل ودار في بلدتين أو أكثر، ولم يكن من نيّة أهله الخروج منها؛ وإن كان ينتقل من أهل إلى أهل في السّنة، حتّى إنّه لو خرج مسافراً من بلدة فيها أهله، ودخل بلدةً أخرى فيها أهله؛ فإنّه يصير مقيمًا من غير نيّة الإقامة([2] .
