أنواع الوطن بالمفهوم الشرعي:
للوطن أنواع: وطن أصلي، ووطن إقامة، ووطن سكنى.
الوطن الأصلي، ما ينتقض به الوطن الأصليّ.
وطن الإقامة، ما ينتقض به وطن الإقامة.
وطن السكنى، ما ينتقض به وطن السكنى.
صيرورة المقيم مسافراً، وشرائطها.
تحديد أقل مسافة السفر بالأيام.
أحكام السفر بالوسائل الحديثة:
مثل السفر بالسيارة والقطار والطائرة، حيث الراحة وقصر المدة.
عند جمهور الفقهاء([1] : لو قطع المسافر مسافة السفر المحددة في زمن أقل؛ لاستعماله وسائل أسرع: فإنه يقصر الصلاة؛ لأنه يصدق عليه أنه سافر مسافة القصر.
واختلف الكلام عند الحنفية([2] ، فنقل الكاساني ما روي عن أبي حنيفة من: أن المسافر لو سار إلى موضع في يوم أو يومين، وأنه بسير الإبل، والمشي المعتاد ثلاثة أيام فإنه يقصر الصلاة؛ اعتباراً للسير المعتاد، وهذا القول يوافق المذاهب السابقة؛ لأن أبا حنيفة اعتبر أن العلة هي قطع المسافة.
لكن الكمال بن الهمام: اعتبر أن العلة لِقَصْرِ الصلاة في السفر هي المشقة التي تلحق بالمسافر، ولذلك يذكر: أن المسافر لو قطع المسافة في ساعة: فإنه لا يقصر الصلاة؛ وإن كان يصدق عليه أنه قطع مسافة ثلاثة أيام بسير الإبل؛ لانتفاء مظنة المشقة، وهي العلة.
