الحكم التّكليفيّ لقصر الصلاة:
ذهب الشّافعيّة والحنابلة: إلى أنّ قصر الصلاة جائز، تخفيفاً على المسافر؛ لما يلحقه من مشقّة السّفر غالباً.
واستدلّوا بالآية الكريمة: {وَإِذَا ضَرَبْتُمْ فِي الأَرْضِ فَلَيْسَ عَلَيْكُمْ جُنَاحٌ أَنْ تَقْصُرُوا مِنَ الصَّلاَةِ إِنْ خِفْتُمْ أَنْ يَفْتِنَكُمُ الَّذِينَ كَفَرُوا} [النساء: 101]، فقد علّق قصر الصلاة على الخوف؛ لأنّ غالب أسفار النّبيّ صلى الله عليه وسلم لم تَخْلُ منه، ونفي الجُنَاح في الآية يدلّ على جواز قصر الصلاة، لا على وجوبه.
وذهب الحنفيّة: إلى أنّ فرض المسافر من ذوات الأربع ركعتان لا غير، فليس للمسافر عندهم أن يتمّ الصّلاة أربعاً.
لقول عائشة رضي الله عنها: "فُرِضَتِ الصَّلاَةُ رَكْعَتَيْنِ رَكْعَتَيْنِ، فَأُقِرَّتْ صَلاَةُ السَّفَرِ، وَزِيدَ فِي صَلاَةِ الْحَضَرِ"([1] ، ولا يعلم ذلك إلاّ توقيفاً([2] .
وقول ابن عباس رضي الله عنهما: إن الله عز وجل فرض الصلاة على لسان نبيكم صلى الله عليه وسلم على المسافر ركعتين، وعلى المقيم أربعاً، وفي الخوف ركعة([3] .
والراجح المشهور عند المالكية: أن قصر الصلاة سنة مؤكدة؛ فإنه لم يصحَّ عن رسول الله صلى الله عليه وسلم أنه أتم الصلاة في السفر، بل المنقول عنه قصر الصلاة في أسفاره كلها، وما كان هذا شأنه فهو سنة مؤكدة([4] .
