اقتداء المسافر بالمقيم، وعكسه:
عند الحنفية([1] : يصح اقتداء المسافر بالمقيم في الوقت الواحد، وينقلب فرض المسافر أربعاً عند عامة الفقهاء من الحنفية؛ لأنه لما اقتدى به صار تبعاً له؛ لأن متابعته واجبة عليه؛ لقول رسول الله صلى الله عليه وسلم: "إِنَّمَا جُعِل الإِمَامُ لِيُؤْتَمَّ بِهِ؛ فَلاَ تَخْتَلِفُوا عَلَيْهِ"([2] .
وأما اقتداء المقيم بالمسافر فيصح في الوقت نفسه، وخارج الوقت، وإذا سلم الإمام المسافر على رأس الركعتين لا يسلم المقيم، ولكنه يقوم ويتمها أربعاً.
لقول رسول الله صلى الله عليه وسلم: "أَتِمُّوا يَا أَهْل مَكَّةَ صَلاَتَكُمْ؛ فَإِنَّا قَوْمٌ سَفْرٌ"([3] .
ويقول الإمام المسافر ذلك للمقيمين؛ اقتداء برسول الله صلى الله عليه وسلم.
وعند المالكية([4] : يجوز اقتداء المسافر بالمقيم مع الكراهة، ويلزمه الإتمام ولو نوى القصر؛ لمتابعة الإمام.
ويجوز اقتداء المقيم بالمسافر مع الكراهة، ويسلم المسافر، ويتم المقيم.
وعند الشافعية والحنابلة([5] : يجوز اقتداء المسافر بالمقيم، ويلزمه الإتمام.
كما يجوز اقتداء المقيم بالمسافر، مع الإتمام.
