الفصل الثالث: صلاة الوتر
تعريف الوتر.
الحكم التكليفي لصلاة الوتر.
وقت صلاة الوتر.
عدد ركعات صلاة الوتر.
صفة صلاة الوتر: من حيث الفصل والوصل. ومن حيث الجهر والإسرار. ومن حيث ما يقرأ في صلاة الوتر.
رابعاً: القنوت في الصلاة: وهو منحصر في ثلاثة مواطن: صلاة الصبح، وصلاة الوتر، وفي النوازل.
ج - القنوت عند النازلة:
للفقهاء في حكم القنوت عند النوازل أربعة أقوال:
(الأول) للحنفية: وهو أنه لا يقنت في غير الوتر إلا لنازلة؛ كفتنة، وبلية، فيقنت الإمام في الصلاة الجهرية([1] .
(والثاني) للمالكية في المشهور والشافعية في غير الأصح: وهو أنه لا يقنت في غير الصبح مطلقاً([2] ، ودليلهم على ذلك ما في الصحيحين عن أنس وأبي هريرة رضي الله عنهما أنه صلى الله عليه وسلم قَنَتَ شَهْرًا ثُمَّ تَرَكَهُ([3] .
(والثالث) للشافعية في الصحيح المشهور وبعض المالكية: وهو أنه إذا نزلت بالمسلمين نازلة؛ كوباء، وقحط، أو مطر يضر بالعمران أو الزرع، أو خوف عدو، قنتوا في جميع الصلوات المكتوبة([4] .
واستدلوا على ذلك بحديث ابن عباس رضي الله عنهما قَنَتَ رَسُول اللَّهِ صلى الله عليه وسلم شَهْرًا مُتَتَابِعًا فِي الظُّهْرِ وَالْعَصْرِ وَالْمَغْرِبِ وَالْعِشَاءِ وَالصُّبْحِ، يَدْعُو عَلَى رَعْلٍ وَذَكْوَانَ وَعُصَيَّةَ، فِي دُبُرِ كُل صَلاَةٍ، إِذَا قَال: سَمِعَ اللَّهُ لِمَنْ حَمِدَهُ مِنَ الرَّكْعَةِ الأَخِيرَةِ، وَيُؤَمِّنُ مَنْ خَلْفَهُ([5] .
(والرابع) للحنابلة على الراجح عندهم: وهو أنه يكره القنوت في غير وتر إلا أن تنزل بالمسلمين نازلة؛ لأنه لم يثبت القنوت([6] ؛ لما روي عن النبي صلى الله عليه وسلم أَنَّهُ قَنَتَ شَهْرًا يَدْعُو عَلَى حَيٍّ مِنْ أَحْيَاءِ الْعَرَبِ، ثُمَّ تَرَكَهُ([7] .
