تعريف الاستسقاء
لغة([1] : طلب السقيا، أي طلب إنزال الغيث على البلاد والعباد.
والاسم: السُّقيا بالضم، واستسقيتَ فلاناً: إذا طلبتَ منه أن يسقيك.
والمعنى الاصطلاحي للاستسقاء هو([2] : طلب إنزال المطر من الله بكيفية مخصوصة عند الحاجة إليه.
صفته (حكمه التكليفي):
قال الشافعية، والحنابلة، ومحمد بن الحسن من الحنفية: الاستسقاء سنة مؤكدة، سواء أكان بالدعاء والصلاة، أم بالدعاء فحسب، فعله رسول الله صلى الله عليه وسلم وصحابته والمسلمون من بعدهم. وأما أبو حنيفة فقال بسنية الدعاء فحسب، وبجواز غيره([3] .
وعند المالكية تعتريه الأحكام الثلاثة التالية([4] :
الأول: سنة مؤكدة، إذا كان للمَحْلِ والجَدْب، أو للحاجة إلى الشرب لشفاههم، سواء أكانوا في حضر، أم سفر في صحراء، أو سفينة في بحر مالح.
الثاني: مندوب، وهو الاستسقاء ممن كان في خصب لمن كان في مَحْل وجدب؛ لأنه من التعاون على البر والتقوى. ولما جاء في الحديث: "تَرَى الْمُؤْمِنِينَ فِي تَرَاحُمِهِمْ وَتَوَادِّهِمْ وَتَعَاطُفِهِمْ كَمَثَل الْجَسَدِ، إِذَا اشْتَكَى مِنْهُ عُضْوٌ تَدَاعَى لَهُ سَائِرُ جَسَدِهِ بِالسَّهَرِ وَالْحُمَّى"([5] .
وفي الحديث الصحيح: "دَعْوَةُ الْمَرْءِ الْمُسْلِمِ لأَخِيهِ بِظَهْرِ الْغَيْبِ مُسْتَجَابَةٌ، عِنْدَ رَأْسِهِ مَلَكٌ مُوَكَّلٌ، كُلَّمَا دَعَا لأَخِيهِ بِخَيْرٍ، قَال الْمَلَكُ الْمُوَكَّل بِهِ: آمِينَ، وَلَك بِمِثْلٍ"([6] .
الثالث: مباح، وهو استسقاء من لم يكونوا في محل، ولا حاجة إلى الشرب، وقد أتاهم الغيث، ولكن لو اقتصروا عليه لكان دون السعة، فلهم أن يسألوا الله من فضله.
