الفصل الأول: مفهوم الزكاة
تعريف الزكاة.
الحكم التكليفي للزكاة.
مَن تجب في ماله الزكاة.
الزكاة في مال الصغير والمجنون:
ذهب المالكية والشافعية والحنابلة إلى([1] : أن الزكاة تجب في مال كل من الصغير والمجنون ذكراً كان أو أنثى.
واستدلوا بقول النبي صلى الله عليه وسلم: "أَلاَ مَنْ وَلِيَ يَتِيمًا لَهُ مَالٌ فَلْيَتَّجِرْ فِيهِ، وَلاَ يَتْرُكْهُ حَتَّى تَأْكُلَهُ الصَّدَقَةُ"([2] ، والمراد بالصدقة الزكاة المفروضة؛ لأن اليتيم لا يخرج من ماله صدقة تطوع؛ إذ ليس للولي أن يتبرع من مال اليتيم بشيء، ولأن الزكاة حق يتعلق بالمال.
ويتولى الولي إخراج الزكاة من مالهما؛ لأن الولي يقوم مقامهما في أداء ما عليهما من الحقوق.
وعلى الولي أن ينوي أنها زكاة، فإن لم يخرجها الولي وجب على الصبي بعد البلوغ، والمجنون بعد الإفاقة، إخراج زكاة ما مضى.
وذهب أبو حنيفة إلى([3] : أن الزكاة لا تجب في مال الصغير والمجنون، إلا أنه يجب العشر في زروعهما وثمارهما، وزكاة الفطر عنهما.
واستدل لهذا القول بقول النبي صلى الله عليه وسلم: "رُفِعَ الْقَلَمُ عَنْ ثَلاَثَةٍ: عَنِ الْمَجْنُونِ الْمَغْلُوبِ عَلَى عَقْلِهِ حَتَّى يُفِيقَ، وَعَنِ النَّائِمِ حَتَّى يَسْتَيْقِظَ، وَعَنِ الصَّبِيِّ حَتَّى يَحْتَلِمَ"([4] ، ولأنها عبادة، فلا تتأدى إلا بالاختيار؛ تحقيقاً لمعنى الابتلاء، ولا اختيار للصبي والمجنون لعدم العقل، وإنما وجب العشر فيما يخرج من أرضهما؛ لأنه في معنى مؤنة الأرض.
