الفصل الأول: مفهوم الزكاة
تعريف الزكاة.
الحكم التكليفي للزكاة.
مَن تجب في ماله الزكاة.
الزكاة في مال الصغير والمجنون.
الزكاة في الأموال المشتركة والأموال المختلفة والأموال المتفرقة.
شروط المال الذي تجب فيه الزكاة:
الشرط الأول: كون المال مملوكاً لمعين.
الشرط الثاني: أن تكون ملكية المال مطلقة:
الملك الناقص يكون في أنواع من المال معينة، منها:
كيف تكون زكاة الديون؟
القرار([1] : في ضوء مباحثات وآراء المشاركين اتفق الملتقى على ما يلي:
1 - الدَّيْن ينقسم إلى قسمين: دَيْن غير مرجو حصوله، ودَيْن مرجو حصوله.
فالدَّيْن الذي لا يرجى حصوله لأي سبب، إذا تم أداؤه يوماً؛ فالزكاة تجب عليه بعد مضي سنة كاملة من ذلك اليوم.
2 - إذا كان المدين يماطل في تسديد الدَّيْن رغم مطالبة الدائن حتى ييأس الدائن من حصوله على دَيْنه؛ فزكاة هذا الدَّيْن لا تجب على الدائن، وإذا حَصَّلَ هذا الدَّيْن في أي يوم فبعد مضي سنة من ذلك اليوم - يوم تحصيله - تجب الزكاة عليه.
3 - الدَّيْن الذي يرجى حصوله ينقسم إلى ثلاثة أقسام:
1) دَيْن هو بَدَل - عوض – القرض، أو بَدَل - مقابل- السلع التجارية، ومثل هذا الدَّيْن تجب زكاته بعد الحصول عليه مع زكاة السنين الماضية.
2) دَيْن هو بَدَل مالٍ غيرِ القرض، وثمن عروض التجارة مثل: مال الوراثة، والوصية.
3) دَيْن ليس هو بَدَل مال مثل: المهر.
وفي هاتين الصورتين تجب الزكاة بعد مضى سنة من يوم الحصول عليه، ولا تجب للسنين الماضية.
4 - في الديون طويلة الأجل المعطاة من المؤسسات الرسمية أو غير الرسمية يُخْصَمُ من أموال الزكاة القسطُ اللازم دفعُه سنوياً فقط، لا جميعَ الديون، فتجب الزكاة على بقية الديون.
