ما تجب فيه الزكاة من أجناس النبات:
أجمع العلماء على أن في التمر (ثمر النخل) والعنب (ثمر الكرم) من الثمار، والقمح والشعير من الزروع الزكاةَ إذا تمت شروطها.
وإنما أجمعوا على ذلك لما ورد فيها من الأحاديث الصحيحة، منها حديث عبد الله بن عمرو رضي الله عنهما مرفوعاً: "الزَّكَاةُ فِي الْحِنْطَةِ وَالشَّعِيرِ وَالتَّمْرِ وَالزَّبِيبِ"([1] ،
وفي لفظ: "الْعُشْرُ فِي التَّمْرِ وَالزَّبِيبِ وَالْحِنْطَةِ وَالشَّعِيرِ"([2] ،
ومنها حديث عمر بن الخطاب رضي الله عنه قال: إِنَّمَا سَنَّ رَسُول اللَّهِ صلى الله عليه وسلم الزَّكَاةَ فِي هَذِهِ الأَرْبَعَةِ؛ الْحِنْطَةِ، وَالشَّعِيرِ، وَالزَّبِيبِ، وَالتَّمْرِ([3] ،
وعن أبي بردة عن أبي موسى ومعاذ رضي الله عنهم أجمعين أن رسول الله صلى الله عليه وسلم بعثهما إلى اليمن يعلمان الناس أمر دينهم، فَأَمَرَهُمْ أَنْ لاَ يَأْخُذُوا الصَّدَقَةَ إِلاَّ مِنْ هَذِهِ الأَرْبَعَةِ: الْحِنْطَةِ وَالشَّعِيرِ وَالتَّمْرِ وَالزَّبِيبِ([4] .
ونقول: إن هذا الوجوب ليس حصرياً، وإنما هو في توجيه السعاة (جباة الزكاة) ألا يأخذوا من المزارعين إلا الأموال الظاهرة، ويتركوا بقية الزروع والأموال (الباطنة) ليؤدي المكلف زكاتها بنفسه.
