الفصل الرابع: مصارف الزكاة:
بيان الأصناف الثمانية:
المبحث الأول: الصنفان الأول والثاني: الفقراء والمساكين.
الغنى المانع من أخذ الزكاة بوصف الفقر أو المسكنة.
إعطاء الفقير والمسكين القادرين على الكسب.
القَدْر الذي يعطاه الفقير والمسكين من الزكاة.
مصرف الفقراء والمساكين ([1] :
أولاً: الفقير هو الذي لا مال له ولا كسب يقع موقعاً من كفايته، والمسكين هو الذي يملك ما يقع موقعاً من كفايته ولا يكفيه لمدة سنة.
ثانياً: يُعطى مِن سهم الفقراء والمساكين ما يلي:
1- مَن كان بحاجة إلى الزواج، وهو عاجز عن تكاليفه المعتادة لمثله.
2- طالب العلم العاجز عن الجمع بين طلب العلم والتكسب.
3- العاجزون عن التكسب.
4- مَن لم يجد عملاً يليق بمكانته ومروءته.
5- العاملون في وظائف عامة أو خاصة مِمَن لا تكفي دخولهم مِن مرتبات أو غيرها لسدِّ حاجاتهم.
6- آل البيت الذين لا يُعطون كفايتهم مِن بيت المال.
7- الزوج الذي لا يملك كفايته، ولا يقدر على تحصيلها، فيجوز لزوجته أن تعطيه من زكاة مالها.
ثالثاً: لا يَخْرُج عن وصف الفقر أو المسكنة مَن تحقَّق فيه المعنى المتقدم في (أولاً) مَن يلي:
مَن له مسكن ملائم يحتاج إليه فلا يكلف بيعه للإنفاق منه.
مَن له مال لا يقدر على الانتفاع به، ولا يتمكن من الحصول عليه.
مَن له نصاب أو نُصب (جمع نصاب) لا تفي بحوائجه وحوائج مَن يعولهم.
مَن له عقار يُدر عليه ريعاً لا يفي بحاجته.
مَن لها حلي تتزين بها ولا تزيد عن حوائج مثلها عادة - أي إن ذهبها يناسب قريباتها ومثيلاتها دون زيادة -.
مَن له أدوات حرفة (صنعة) يحتاج إلى استعمالها في صنعته، ولا يكفي كسبه منها ولا مِن غيرها حاجته.
مَن كانت لديه كتب علم يحتاج إليها سواء كانت كتب علوم شرعية، أو كانت كتب علوم أخرى نافعة.
مَن كان له دَيْن لا يستطيع تحصيله لكونه مؤجلاً، أو على مدين مفلس، أو مماطل.
رابعاً: يُعطى الفقير والمسكين كفايته لمدة عام.
خامساً: يُقصد بالكفاية كل ما يحتاج إليه هو ومَن يعولهم مِن مطعم، وملبس، ومسكن، وأثاث، وعلاج، وتعليم أولاده، وكتب علم إن كان ذلك لازماً لأمثاله، وكل ما يليق به عادة من غير إسراف ولا تقتير.
سادساً: مراعاة حاجات المسلم بلا تفريق بين فقير وفقير باعتبار جنسيته.
سابعاً: نظراً لشيوع ادعاء الفقر والمسكنة ينبغي التحري في حالة الاشتباه قبل الإعطاء، ويراعى في ذلك وسائل الإثبات الشرعية.
ثامناً: لا يُعطى من سهم الفقراء والمساكين مَن يلي:
الأغنياء، وهم مَن يملكون كفايتهم وكفاية مَن يعولونهم لمدة سنة.
الأقوياء المكتسبون الذين يقدرون على تحقيق كفايتهم وكفاية مَن يعولونهم.
آل البيت الذين يُعطون كفايتهم من بيت المال.
غير المسلمين.
