الدَّيْن على الميت.
مصرف (الغارمين)([1] :
الغارمون قسمان:
الأول: المدينون المسلمون الفقراء لمصحلة أنفسهم في المباح، وكذا بسبب الكوارث والمصائب التي أصابتها.
والثاني: المدينون المسلمون لإصلاح ذات البين، لتسكين الفتن التي قد تثور بين المسلمين، أو للإنفاق في المصائب والكوارث التي تَحِلُّ بالمسلمين، ولا يشترط الفقر في هذا القسم.
الضامن مالاً عن رجل معسر يجوز إعطاؤه ما ضمنه إن كان الضامن عسراً.
لا يجوز إعطاء الغارم لمصلحة نفسه من الزكاة إذا كان دَيْنه في معصية؛ كالخمر، والميسر، والربا، إلا إذا تحقق (مؤدي الزكاة) صدق توبته (توبة الغارم بسبب معصية).
يجوز قضاء دَيْن الميت من مال الزكاة إذا لم يكن في ميراثه ما يفي به، ولم يسدد ورثتُه دَيْنَه، ففي تسديد دَيْنه من الزكاة إبراءٌ لذمته، وحفظٌ لأموال الدائنين.
الغارمُ لمصلحة نفسه القويُ المكتسبُ لا يجوز له أن يأخذ من مال الزكاة إذا أمكنه سداد دَيْنه من كسبه، أو أنظره (صبر عليه) صاحب المال إلى ميسرة، وكذلك مَن كان له مال؛ سواء كان نقداً أو عقاراً أو غيرها يمكنه السداد منه.
إذا أخذ الغارمُ من الزكاة بوصف الغرم؛ فلا يجوز له أن ينفق هذا المال إلا في سداد غرمه، أما إذا أخذه بوصف الفقر فيجوز له إنفاقه في حاجاته.
الغارم الفقير، أو الغارم المسكين أولى بالزكاة من الفقير أو المسكين الذي ليس بغارم؛ لأن الأوَّلَين اجتمع فيهم وصفان: الغرم والفقر أو الغرم والمسكنة، والآخرَيْن ليس فيهما إلا وصف الفقر أو المسكنة دون الغرم.
يجوز إعطاء الغارم من الزكاة بمقدار ما عليه من ديون قَلَّت أو كثرت، إذا كان في مال الزكاة وفاءٌ لتلك الديون، أو إن استغنى([2] الغارم قبل سداد ما عليه من ديون وجب عليه إرجاع تلك الأموال لولي الأمر، أو لِمَن أخذها منه، فإن لم يستطع، فإنه يدفعها في مصارف الزكاة.
يجوز إعطاء الغارم من مال الزكاة للعام - للسنة - الذي يَحِلُّ دَيْنه فيه، ولو بقي من ذلك العام - السنة - أشهر على موعد السداد، ولا يُعطى لسداد دَيْن العام التالي، إلا أن يصالح المدينُ صاحبَ الدَّيْن على السداد في الحال، مع الحط (النقيصة) من الدَّيْن.
لا ينبغي لمن يجد دَخلاً يكفيه أن يستدين لإنشاء مصنع، أو مزرعة، أو مسكن، اعتماداً منه على السداد من مال الزكاة، فمال الزكاة يُعطَى لسد حاجة الفقراء، أو إيجاد دخل لهم يسد حاجتهم، ولا يعطى لمن لديه ما يكفيه؛ ليزداد ثراء.
يعطى ذوو قرابة الرسول e الغارمون من هذا المصرف، إذا انقطعت حقوقهم المقررة شرعاً.
