هل يصح الزواج من مال الزكاة؟
السؤال: يتقدم بعض راغبي الزواج بطلب مساعدة من (صندوق الزكاة) الموجود في المصرف (البنك) - في بعض الدول - والمطلوب وضع الضوابط والأسس التي يمكن لصندوق الزكاة بالمصرف (البنك) مساعدة راغبي الزواج على أساسها؟.
الجواب([1] : إن الإسلام في كثير من آيات القرآن الكريم والأحاديث النبوية الصحيحة يأمر المسلم بالنكاح إذا كان قادراً عليه، وتنهاه (النصوص الشرعية) عن التبتل؛ لإرادة الله في عمارة الكون وبقاء النوع الإنساني، كما أوجب الإسلام على ولي الأمر؛ ممثلاً في الحكومة، أو مؤسسة الزكاة مَدَّ يَدِ المساعدة إلى راغب الزواج إذا كان من أهل الحاجة، باعتبار أن الزواج من تمام كفاية الفقير والمسكين، حتى قال بعض العلماء: إن الزواج فريضة على المسلم، لا يحل تركه ما دام قادراً عليه، وقال آخرون: إن من تمام الكفاية ما يأخذه الفقير ليتزوج إذا لم تكن له زوجة، واحتاج للنكاح فهو في هذه الحالة من الضرورات.
فترى الهيئة جواز مساعدة راغب الزواج من (صندوق الزكاة) بعد بحث حالتهم، والتأكد من أنهم من أهل الحاجة، بشرط أن تقتصر مساعدتهم على كفاية الحاجات الضرورية لأواسط الناس من أهل زمنهم وبيئتهم، وفق الضوابط الشرعية التي تأمر بالتيسير، وعدم المغالاة، والبعد عن الإسراف والتبذير.
