سبب الوجوب ووقته:
ذهب الحنفية إلى أن وقت وجوب زكاة الفطر هو طلوع فجر يوم العيد، وهو أحد قولين مصححين للمالكية؛ واستدلوا بما رواه نافع عن ابن عمر رضي الله عنهما قال: أَمَرَ رَسُول اللَّهِ صلى الله عليه وسلم بِزَكَاةِ الْفِطْرِ أَنْ تُؤَدَّى قَبْل خُرُوجِ النَّاسِ إِلَى الصَّلاَةِ([1] ، دل الحديث على أن أداءها الذي ندب إليه الشارع هو قبل الخروج إلى مصلى العيد، فعُلِم أن وقت وجوبها هو يوم الفطر، ولأن تسميتَها صدقةَ الفطر، تدلُ على أن وجوبها بطلوع فجر يوم الفطر؛ لأن الفطر إنما يكون بطلوع فجر ذلك اليوم، أما قبله فليس بفطر؛ لأنه في كل ليلة من ليالي رمضان يصوم ويفطر، فيعتبر مفطراً من صومه بطلوع ذلك اليوم([2] .
وذهب الشافعية في الأظهر والحنابلة، إلى أن الوجوب هو بغروب شمس آخر يوم من رمضان، وهو أحد قولين للمالكية([3] ؛ لقول ابن عباس رضي الله عنهما: فَرَضَ رَسُول اللَّهِ صلى الله عليه وسلم صَدَقَةَ الْفِطْرِ طُهْرَةً لِلصَّائِمِ مِنَ اللَّغْوِ وَالرَّفَثِ، وَطُعْمَةً لِلْمَسَاكِينِ، فَمَنْ أَدَّاهَا قَبْل الصَّلاَةِ فَهِيَ زَكَاةٌ مَقْبُولَةٌ، وَمَنْ أَدَّاهَا بَعْدَ الصَّلاَةِ فَهِيَ صَدَقَةٌ مِنَ الصَّدَقَاتِ([4] .
ويظهر أثر الخلاف فيمن مات بعد غروب شمس آخر يوم من رمضان:
فعند الشافعية ومن وافقهم تُخْرَج عنه صدقة الفطر؛ لأنه كان موجوداً وقت وجوبها، وعند الحنفية ومن وافقهم لا تُخْرَج عنه صدقة الفطر؛ لأنه لم يكن موجوداً وقت وجوبها.
ومن ولد بعد غروب شمس آخر يوم من رمضان تخرج عنه صدقة الفطر عند الحنفية ومن وافقهم؛ لأنه وقتَ وجوبها كان موجوداً، ولا تخرج عنه الصدقة عند الشافعية ومن وافقهم؛ لأنه كان جنيناً في بطن أمه وقت وجوبها.
ومن أسلم بعد غروب الشمس من آخر يوم من رمضان، لا تُخْرَج عنه الصدقة عند الشافعية ومن وافقهم؛ لأنه وقت وجوبها لم يكن أهلاً، وعند الحنفية ومن وافقهم تخرج عنه صدقة الفطر؛ لأنه وقت وجوبها كان أهلاً([5] .
