ذهب جمهور الفقهاء إلى تحريم صوم الأيام التالية:
أ - صوم يوم عيد الفطر، ويوم عيد الأضحى، وأيام التشريق، وهي ثلاثة أيام بعد يوم النحر( [1] ) .
وذلك لأن هذه الأيام منع صومها؛ لحديث أبي سعيد رضي الله عنه أن رسول الله صلى الله عليه وسلم نهى عن صيام يومين: يوم الفطر، ويوم النحر( [2] ) ، وحديث نُبَيْشَةُ الْهُذَلِيُّ رضي الله عنه قال: قال رسول الله صلى الله عليه وسلم: "أَيَّامُ التَّشْرِيقِ أَيَّامُ أَكْلٍ وَشُرْبٍ، وَذِكْرِ اللَّهِ عَزَّ وَجَل"( [3] ) .
وذهب الحنفية إلى جواز الصوم فيها مع الكراهة التحريمية؛ لما في صومها من الإعراض عن ضيافة الله تعالى، فالكراهة ليست لذات اليوم، بل لمعنى خارجٍ مجاورٍ( [4] ) .
