طرق إثبات الهلال:
أولاً: الرؤية بالعين:
رؤية هلال شوال وبقية الشهور:
اتفق جمهور الفقهاء على اشتراط رؤية عدلين في هلال شوال، واختلفوا في بعض التفصيلات.
فاشترط الحنفية لإثبات هلال شوال في حالة الصحو أن يكون الشهود جماعة يحصل العلم للقاضي بخبرهم كما في هلال رمضان، ولم يقبلوا في حال الغيم إلا شهادةَ رجلين، أو رجلٍ وامرأتين مسلمين عاقلين بالغين، كما في الشهادة في الحقوق والأموال؛ لأن الإخبار بهلال شوال من باب الشهادة. وفيه نفع للمخبِر، وهو إسقاط الصوم عنه فكان متهماً فاشترط فيه العدد؛ نفياً للتهمة؛ بخلاف هلال رمضان؛ فإنه لا تهمة فيه( [1] ) .
واشترط المالكية في هلال شوال الرؤية المستفيضة أو شهادةَ عدلين ممن يشهدون في الحقوق العامة. ونصوا على أن مَن رأى هلال شوال وحده لا يفطر؛ خوفاً من التهمة، وسداً للذريعة( [2] ) .
واشترط الشافعية والحنابلة في ثبوت هلال شوال شهادة رجلين عدلين؛ احتياطاً للفرض( [3] ) .
