الألفاظ ذات الصّلة بالفقه:
أ - الشّريعة:
الشّريعة والشّرعة في اللّغة: مورد الماء للاستسقاء، سمّي بذلك لوضوحه وظهوره، والشّرع مصدر شرع بمعنى: وضح وظهر، وتجمع على شرائع، ثمّ غلب استعمال هذه الألفاظ في الدّين وجميع أحكامه، قال تعالى: {ثُمَّ جَعَلْنَاكَ عَلَى شَرِيعَةٍ مِّنَ الأَمْرِ فَاتَّبِعْهَا} [الجاثية: 18]، وقال سبحانه: {لِكُلٍّ جَعَلْنَا مِنكُمْ شِرْعَةً وَمِنْهَاجاً} [المائدة: 48].
وفي الاصطلاح: هي ما نزل به الوحي على رسول اللّه من الأحكام في الكتاب أو السّنّة ممّا يتعلّق بالعقائد والوجدانيّات وأفعال المكلّفين قطعيّاً كان أو ظنّيّاً([1] ) .
وبين الشّريعة والفقه عموم وخصوص من وجه، يجتمعان في الأحكام العمليّة الّتي وردت بالكتاب أو بالسّنّة أو ثبتت بإجماع الأمّة، وتنفرد الشّريعة في أحكام العقائد، وينفرد الفقه في الأحكام الاجتهاديّة الّتي لم يرد فيها نصّ من الكتاب أو السّنّة ولم يجمع عليه أهل الإجماع.
الحكم التّكليفيّ لمعرفة علم الفقه:
تعلّم الفقه قد يكون فرض عين على المكلّف؛ كتعلّمه ما لا يتأدّى الواجب الّذي تعيّن عليه فعله إلاّ به، مثل: تعلم كيفيّة الوضوء والصّلاة، والصّوم ونحو ذلك، بدليل قول رسول الله : "طَلَبُ الْعِلْمِ فَرِيضَةٌ عَلَى كُل مُسْلِمٍ"([2] ) .
وقد يكون تعلّم الفقه نافلةً، وهو التّبحّر في أصول الأدلّة والإمعان فيما وراء القدر الّذي يحصل به فرض الكفاية، وتعلّم العامّيّ نوافل العبادات لغرض العمل، لا ما يقوم به العلماء من تمييز الفرض من النّفل، فإنّ ذلك فرض كفاية في حقّهم.
فضل الفقه:
وردت آيات وأحاديث في فضل الفقه والحثّ على تحصيله، ومن ذلك قول اللّه تعالى: {وَمَا كَانَ الْمُؤْمِنُونَ لِيَنفِرُواْ كَآفَّةً فَلَوْلاَ نَفَرَ مِن كُلِّ فِرْقَةٍ مِّنْهُمْ طَآئِفَةٌ لِّيَتَفَقَّهُواْ فِي الدِّينِ وَلِيُنذِرُواْ قَوْمَهُمْ إِذَا رَجَعُواْ إِلَيْهِمْ لَعَلَّهُمْ يَحْذَرُونَ} [التوبة: 22]، فقد جعل الله ولاية الدّعوة إلى الله للفقهاء، وهي وظيفة الأنبياء عليهم السلام.
وقال رسول الله : "مَنْ يُرِدِ اللَّهُ بِهِ خَيْرًا يُفَقِّهْهُ فِي الدِّينِ"([3] ) .
موضوع الفقه:
موضوع علم الفقه هو أفعال المكلّفين من العباد، فيبحث فيه عمّا يعرض لأفعالهم من حلّ وحرمة، ووجوب وندب وكراهة.
