اختلاف المطالع( [1] ) :
اختلاف مطالع الهلال أمر واقع بين البلاد البعيدة، وبخاصة عند اختلاف خطوط الطول والعرض.
لكن هل يعتبر ذلك في بدء صيام المسلمين، وفي توقيت عيدي الفطر والأضحى وسائر الشهور فتختلف بينهم بدءاً ونهاية، أم لا يعتبر بذلك، ويتوحد المسلمون في صومهم وفي عيديهم؟.
ذهب جمهور الفقهاء إلى أنه لا عبرة باختلاف المطالع؛ بمعنى إذا ثبتت رؤية الهلال في بلد مسلم، وجب على جميع المسلمين اعتماد هذه الرؤية في بدء الصيام، وفي بدء سائر الأهلة.
وعمل الشافعية باختلاف المطالع فقالوا: (إن لكل بلد رؤيتَهم، وإن رؤية الهلال ببلد لا يَثْبُت بها حكمُه لما بَعُدَ عنهم).
استدل القائلون بعدم اعتبار اختلاف المطالع بحديث رسول الله صلى الله عليه وسلم: "صُومُوا لِرُؤْيَتِهِ وَأَفْطِرُوا لِرُؤْيَتِهِ"( [2] ) ، فقد أوجب هذا الحديث الصوم بمطلق الرؤية لجميع المسلمين دون تقييدها بمكان.
