الباب الخامس:
كتاب الصيام
تعريف الصوم.
الحكم التكليفي.

صوم مَن رأى الهلال وحده:
مَن رأى هلال رمضان وحده، ورُدَّت شهادته، لزمه الصوم وجوباً، عند جمهور الفقهاء وهو مشهور مذهب أحمد([1] ) .
وذلك لقوله تعالى: {فَمَنْ شَهِدَ مِنْكُمُ الشَّهْرَ فَلْيَصُمْهُ} [البقرة: 185]،
ولحديث رسول الله صلى الله عليه وسلم: "صُومُوا لِرُؤْيَتِهِ وَأَفْطِرُوا لِرُؤْيَتِهِ"([2] ) ،
وحديث رسول الله صلى الله عليه وسلم: "الصَّوْمُ يَوْمَ تَصُومُونَ، وَالْفِطْرُ يَوْمَ تُفْطِرُونَ، وَالأَضْحَى يَوْمَ تُضَحُّونَ"([3] ) ؛ ولأنه تيقن أنه من رمضان، فلَزِمَه صومه، كما لو حكم به الحاكم.
وإن رأى هلال شوال وحده، لم يفطر عند جمهور الفقهاء؛ وذلك خوفَ التهمةِ، وسداً للذريعة([4] ) .
وعند الشافعية: له أن يفطر؛ لأنه تيقن من شوال، فجاز له الأكل، كما لو قامت بينة، لكن يفطر سراً([5] ) .
