الباب الخامس:
كتاب الصيام
تعريف الصوم.

شروط الصوم:
شروط وجوب الصوم، هي:
أ - الإسلام، وهو شرط عام للخطاب بفروع الشريعة.
ب - العقل، إذ لا فائدة من توجه الخطاب بدونه، فلا يجب الصوم على مجنون إلا إذا أثم بزوال عقله، في شراب أو غيره، ويلزمه قضاؤه بعد الإفاقة( [1] ) ، وعبر الحنفية بالإفاقة بدلاً من العقل، أي الإفاقة من الجنون والإغماء أو النوم، وهي اليقظة( [2] ) .
ج - البلوغ، ولا تكليف إلا به، لأن الغرض من التكليف هو الامتثال، وذلك بالإدراك والقدرة على الفعل - كما هو معلوم في الأصول - والصبا والطفولة عجز.
د - العلم بالوجوب( [3] ) .
