شروط الصوم:
أهم شرط لصحة الصوم: النية.
وصفة النية أن تكون جازمة، معينة، مبيتة، مجددة، على ما يلي:
أولاً: الجزم.
ثانياً: التعيين([1] ) ، إذ لا بد من تعيين النية في صوم رمضان، وصوم الفرض والواجب، ولا يكفي تعيين مطلق الصوم، ولا تعيين صوم معين غير رمضان.
وكمال النية: أن ينوي صوم غد، عن أداء فرض رمضان هذه السنة لله تعالى([2] ) .
وذهب الحنفية في التعيين إلى تقسيم الصيام إلى قسمين:
القسم الأول: لا يشترط فيه التعيين، وهو: أداء رمضان، والنذر المعين زمانه، وكذا النفل، فإنه يصح بمطلق نية الصوم، من غير تعيين.
وذلك لأن رمضان معيار مضيق، لا يسع غيره من جنسه وهو الصوم، فلم يشرع فيه صوم آخر، فكان متعيَّناً للفرض، والمتعيَّن لا يحتاج إلى تعيين، والنذر المعين معتبر بإيجاب الله تعالى، فيصاب كل منهما بمطلق النية، وبأصلها، وبنية نفل؛ لعدم المزاحم([3] ) .
والقسم الثاني: يشترط فيه التعيين، وهو: قضاء رمضان، وقضاء ما أفسده من النفل، وصوم الكفارات بأنواعها، والنذر المطلق عن التقييد بزمان، سواء أكان معلقاً بشرط، أم كان مطلقاً؛ لأنه ليس له وقت معين، فلم يتأد إلا بنية مخصوصة؛ قطعاً للمزاحمة([4] ) .
