ما يفسد الصوم، ويوجب القضاء:
أولاً: تناول ما لا يؤكل عادة.
ثانياً: قضاء الوطر أو الشهوة على وجه القصور: وذلك في الصور الآتية:
أ - تعمد إنزال المني بلا جماع، وذلك كالاستمناء بالكف، أو بالتبطين، والتفخيذ، أو باللمس، والتقبيل ونحوهما؛ فإنه يوجب القضاء دون الكفارة عند جمهور الفقهاء، وأما عند المالكية يوجب القضاء والكفارة معاً([1] ) .
ب - الإنزال بالفكر والنظر: إنزال المني بالنظر أو الفكر، فيه التفصيل الآتي:
مذهب الحنفية والشافعية أن الإنزال بالفكر وبالنظر بشهوة، لا يفسد الصوم، وإن عَلِم أنه ينزل به، لأنه إنزال من غير مباشرة، فأشبه الاحتلام([2] ) .
ومذهب المالكية أنه إن أمنى بمجرد الفكر أو النظر، من غير استدامة لهما، يفسد صومه، ويجب القضاء دون الكفارة([3] ) .
وعند الشافعية: يفطر إذا علم الإنزال بالفكر والنظر، وإن لم يكرره([4] ) .
ومذهب الحنابلة التفرقة بين النظر وبين الفكر، ففي النظر إذا أمنى يفسد الصوم؛ لأنه أنزل بفعل يتلذذ به، ويمكن التحرز منه، فأفسد الصوم، كالإنزال باللمس، والفكر لا يمكن التحرز منه، بخلاف النظر([5] ) . أما الفكر، فإن الإنزال به لا يفسد الصوم([6] ) .
ج - التدخين:
أجمع الأطباء على أن التدخين مضر، والحق في إفتاء التحليل والتحريم في هذا الزمان التمسك بالأصلين النافعين في الشرع.
الأول: أن الأصل في المنافع: الإباحة، والآيات الدالة على ذلك كثيرة.
الثاني: أن الأصل في المضار: التحريم والمنع؛ لقول النبي صلى الله عليه وسلم: "لاَ ضَرَرَ وَلاَ ضِرَارَ"([7] ) ، فالدخان يحرم؛ لأنه ثبت ضرره.
واتفق الفقهاء على أن شرب الدخان المعروف أثناء الصوم يفسد الصيام؛ لأنه من المفطرات، كذلك يفسد الصوم لو أَدْخَلَ الدخانَ حلقَه من غير شرب، بل باستنشاق له عمداً.
وعند الحنفية والمالكية: إن تعمد ذلك فعليه القضاء والكفارة. وعند الشافعية والحنابلة عليه القضاء فحسب، إذ الكفارة عندهم تكون بالجماع فقط في نهار رمضان([8] ) .
