أجمع الفقهاء على أنه لا يصح اعتكاف الرجل إلا في مسجد؛
لقوله تعالى: {وَأَنْتُمْ عَاكِفُونَ فِي الْمَسَاجِدِ} [البقرة: 187].
وللاتباع؛ لأن النبي صلى الله عليه وسلم لم يعتكف إلا في المسجد.
واتفقوا على أن المساجد الثلاثة أفضل من غيرها، والمسجد الحرام أفضل، ثم المسجد النبوي، ثم المسجد الأقصى.
واتفقوا على أن المسجد الجامع يصح فيه الاعتكاف، وهو أولى من غيره بعد المساجد الثلاثة.
ويجب الاعتكاف فيه إذا نذر الاعتكاف مدة تصادفه فيها صلاة الجمعة؛ لئلا يحتاج إلى الخروج وقت صلاة الجمعة، إلا إذا اشترط الخروج لها عند الشافعية([1] ) .
ثم اختلفوا في المساجد الأخرى التي يصح فيها الاعتكاف.
فذهب الحنفية والحنابلة إلى أنه([2] ) : لا يصح الاعتكاف إلا في مسجد جماعة.
وعن أبي حنيفة أنه لا يصح الاعتكاف إلا في مسجد تقام فيه الصلوات الخمس؛ لأن الاعتكاف عبادة انتظار الصلاة، فيختص بمكان يصلى فيه.
وقال أبو يوسف ومحمد: يصح في كل مسجد.
وعن أبي يوسف أنه فرق بين الاعتكاف الواجب والمسنون، فاشترط للاعتكاف الواجب مسجد الجماعة، وأما النفل فيجوز في أي مسجد كان.
ويعني الحنفية بمسجد الجماعة ما له إمام ومؤذن، أديت فيه الصلوات الخمس أو لا.
واشترط الحنابلة لصحة الاعتكاف في المسجد أن تقام الجماعة في زمن الاعتكاف الذي هو فيه، ولا يضر عدم إقامتها في الوقت الذي لا يعتكف فيه.
والمذهب عند المالكية والشافعية أنه يصح الاعتكاف في أي مسجد كان([3] ) .
