مطلب: ما يفسد الاعتكاف:
يفسد الاعتكاف ما يلي:
الأول - الجماع ودواعيه.
الثاني - الخروج من المسجد.
أ - الخروج لقضاء الحاجة والوضوء والغسل الواجب.
ب - الخروج للأكل والشّرب.
ت - الخروج لغسل الجمعة والعيد.
ث - الخروج لصلاة الجمعة:
مَن وجبت عليه صلاة الجمعة، وكان اعتكافه متتابعاً، وكان قد اعتكف في مسجدٍ لا تقام فيه الجمعة فهو آثمٌ.
ويجب عليه الخروج لصلاة الجمعة؛ لأنّها فرضٌ.
فإذا خرج للجمعة:
فقد ذهب الحنفيّة والحنابلة إلى أنّ خروجه للجمعة لا يُفْسِد اعتكافَه؛ لأنّه خروجٌ لما لا بدّ منه.
وذهب المالكيّة في المشهور عندهم والشّافعيّة إلى أنّ خروج المعتكف لصلاة الجمعة يُفْسِد اعتكافَه وعليه الاستئناف؛ لأنّه يمكنه الاحتراز من الخروج؛ بأن يعتكف في المسجد الجامع الذي تقام فيه صلاة الجمعة ابتداء؛ فإذا لم يفعل، وخرج من معتكفه لأداء صلاة الجمعة بطل اعتكافه.
واستثنى الشّافعيّة ما لو شرط الخروج في اعتكافه لصلاة الجمعة، فَإِنَّ شَرْطَهُ يَصِحُّ، ولا يبطل اعتكافه بخروجه([1] ) .
ما وقت الخروج من المعتكف لأجل صلاة الجمعة، والعودة للمعتكَف؟
ذهب الحنفيّة إلى أنّ الخروج لصلاة الجمعة يكون وقت الزّوال، ومن بَعًدَ مسجدُ اعتكافِه خرج في وقتٍ يدركها.
أمّا الحنابلة فإنّهم قالوا بجواز التّبكير إليها.
واتّفقوا على أنّ المستحبّ بعد صلاة الجمعة التّعجيل بالرّجوع إلى مكان الاعتكاف.
لكن لا يجب عليه التّعجيل؛ لأنّ مكان أداء صلاة الجمعة محلٌّ للاعتكاف.
وكره تنزيهاً المكث بعد صلاة الجمعة؛ لمخالفة ما التزمه من الاعتكاف في مسجد لا تقام فيه صلاة الجمعة بلا ضرورةٍ([2] ) .
