الاعتكاف

يفسد الاعتكاف ما يلي:
الأول - الجماع ودواعيه.
الثاني - الخروج من المسجد.
أ - الخروج لقضاء الحاجة والوضوء والغسل الواجب.
ب - الخروج للأكل والشّرب.
ت - الخروج لغسل الجمعة والعيد.
ث - الخروج لصلاة الجمعة.
ج -الخروج لعيادة المرضى وصلاة الجنازة.
ح - الخروج في حالة النّسيان.
خ - الخروج لأداء الشّهادة.
د - الخروج لمعالجة مرضه:
المرض على قسمين:
أ - المرض اليسير الّذي لا تشقّ معه الإقامة في المسجد؛ كصداعٍ، وحمّى خفيفةٍ، ونحوهما لا يجوز معه الخروج من المسجد؛ إذا كان اعتكافه منذوراً متتابعاً؛ فإن خرج فَسَدَ اعتكافه؛ لأنّه غير مضطرٍّ إليه.
ب- أمّا المرض الشّديد الّذي يتعذّر معه البقاء في المسجد، أو لا يمكن البقاء معه في المسجد؛ بأن يحتاج إلى خدمةٍ، أو فراشٍ، أو مراجعة طبيبٍ،
فقد ذهب الحنفيّة إلى أنّ خروجه مفسدٌ لاعتكافه، ففي الفتاوى الهنديّة: إذا خرج ساعةً بعذر المرض فَسَدَ اعتكافه. علماً بأنّ مذهب أبي يوسف ومحمّدٍ اعتبار نصف النّهار.
وذهب المالكيّة والحنابلة إلى أنّه لا يبطل ولا ينقطع به التّتابع، ويبني على ما مضى إذا شفي، وهو الأصحّ عند الشّافعيّة.
وكذلك إذا كان المرض ممّا يتلوّث به المسجد؛ كالقيء، ونحوه؛ فإنّه لا ينقطع به التّتابع.
أمّا الخروج حالة الإغماء فإنّه لا يقطع الاعتكاف في قولهم جميعاً؛ لأنّه لم يخرج باختياره.
قال الكاسانيّ: وإن أغمي عليه أيّاماً، أو أصابه لممٌ (جنونٌ) فسد اعتكافه، وعليه إذا بَرِأ من مرضه وشافاه الله أن يستقبل الاعتكاف؛ لأنّه لزمه متتابعاً.
وعند الشّافعيّة أنّ المرض والإغماء يحسبان من الاعتكاف([1] ) .
وفي معنى المرض هذا، الخوف من لصٍّ أو حريقٍ عند الشّافعيّة([2] ) .
