الباب السابع:
الحج

الصيد وما يتعلق به:
ما يستثنى من تحريم قتل الصيد للمُحْرِم:
أ - اتفق الفقهاء على جواز قتل الحيوانات التالية في الحِلِّ والحَرَم، للمُحْرِم وغيره، سواء ابتدأت بأذى أو لم تبتدئ، ولا جزاء على مَن قتلها وهي: الغراب، وَالْحِدَأَةُ، والذئب، والحية، والعقرب، والفأرة، والكلب العقور.
لما ورد من الأحاديث في إباحة قتلها: روى مالك عن نافع عن ابن عمر رضي الله عنهما أن رسول الله صلى الله عليه وسلم قال: "خَمْسٌ مِنَ الدَّوَابِّ لَيْسَ عَلَى الْمُحْرِمِ فِي قَتْلِهِنَّ جُنَاحٌ: الْغُرَابُ، وَالْحِدَأَةُ، وَالْعَقْرَبُ، وَالْفَأْرَةُ، وَالْكَلْبُ الْعَقُورُ"( [1] ) .
ب - يجوز قتل كل مؤذ بطبعه مِمَّا لَمْ تَنُصَّ عَلَيْهِ الأَحَادِيثُ، مثل: الأسد، والنمر، والفهد، وسائر السباع.
بل صرح الشافعية والحنابلة أنه مستحب بإطلاقٍ دونَ اشتراطِ شيءٍ.
استدل جمهور الفقهاء على تعميم الحكم في كل مؤذ بأدلة، منها:
حديث أبي سعيد الخدري رضي الله عنه عن النبي صلى الله عليه وسلم قال: "يَقْتُل الْمُحْرِمُ السَّبُعَ الْعَادِيَ، وَالْكَلْبَ الْعَقُورَ، وَالْفَأْرَةَ، وَالْعَقْرَبَ، وَالْحِدَأَةَ، وَالْغُرَابَ"( [2] ) .
ج - ألحق الشافعية والحنابلة بما يُقْتَل في الحَرَم والإحرام كلَّ ما لا يؤكل لحمه.
