النية في الوضوء

ثانياً: الفرائض المختلف فيها في الوضوء:
أ - النية([1] ) :
النية لغة: القصد بالقلب، دون اشتراط التلفظ بها.
عرف الحنفية النية اصطلاحاً بأنها تَوَجُّه القلبِ لإيجاد الفعل؛ جزماً.
وشرعاً: هي أن ينوي المتطهرُ أداءَ الفرض، أو رفعَ حكمِ الحدثِ، أو استباحةَ ما تجب الطهارة له.
حكم النية في الوضوء:
ذهب الحنفية إلى أن النية سنة في الوضوء، ليقع قربةً إلى الله تعالى، واستدلوا على كونه ليس شرطاً ولا فرضاً بقوله تعالى: {يَاأَيُّهَا الَّذِينَ آمَنُوا إِذَا قُمْتُمْ إِلَى الصَّلاَةِ فَاغْسِلُوا وُجُوهَكُمْ وَأَيْدِيَكُمْ إِلَى الْمَرَافِقِ وَامْسَحُوا بِرُءُوسِكُمْ وَأَرْجُلَكُمْ إِلَى الْكَعْبَيْنِ} [المائدة: 6]، فقد أمر بالغَسْل والمسح مطلقاً عن شرط النية، ولا يجوز تقييد المطلق إلا بدليل([2] ) .
وقال الشافعية والحنابلة: إن النية شرط في صحة الوضوء؛ فلا يصح إلا بالنية.
ويرى المالكية: أن النية فرض في الوضوء.
ودليل كون النية في الوضوء شرط صحة، أو فرضاً: قول الله تعالى: {وَمَا أُمِرُوا إِلاَّ لِيَعْبُدُوا اللَّهَ مُخْلِصِينَ لَهُ الدِّينَ} [البينة: 5]، والإخلاص هو عمل القلب، وهو النية، والأمر به يقتضي الوجوب، ولقول النبي صلى الله عليه وسلم: "إِنَّمَا الأَعْمَال بِالنِّيَّاتِ"([3] ) .
وينوي المتوضئ رفع الحدث، أو استباحة مفتقر إلى طُهْر، أو أداء فرض الوضوء([4] ) .
