الفصل الرابع: صلاة الجمعة
زمن مشروعية صلاة الجمعة.

اجتماع العيد والجمعة في يوم واحد([1] :
ذهب الحنفية والمالكية إلى أنه إذا وافق العيدُ يومَ الجمعة فلا يباح لمن شهد العيدَ التخلفُ عن الجمعة.
وذهب الحنابلة إلى أنه إذا اجتمع العيد والجمعة في يوم واحد فصَلُّوا العيدَ والظهرَ جاز، وسقطت الجمعةُ عمَّن حضرَ العيدّ.
لأن النبي صلى الله عليه وسلم صلى العيد، وقال: "مَنْ شَاءَ أَنْ يُجَمِّعَ فَلْيُجَمِّعْ"([2] ،
والأفضل له حضورُها؛ خروجاً من الخلاف.
ويستثنى من ذلك الإمام فلا يسقط عنه حضور الجمعة.
لحديث أبي هريرة رضي الله عنه عن النبي صلى الله عليه وسلم قال: "قَدِ اجْتَمَعَ فِي يَوْمِكُمْ هَذَا عِيدَانِ، فَمَنْ شَاءَ أَجْزَأَهُ مِنَ الْجُمُعَةِ، وَإِنَّا مُجَمِّعُونَ"([3] .
وأجاز الشافعية في اليوم الذي يوافق فيه العيد يوم الجمعة لأهل القرية الذين يبلغهم النداء لصلاة العيد: الرجوعَ وتركَ الجمعة، وذلك فيما لو حضروا لصلاة العيد؛ ولو رجعوا إلى أهليهم فاتتهم الجمعة: فيرخص لهم في ترك الجمعة تخفيفاً عليهم.
ومِن ثمَّ لو تركوا المجيء للعيد وَجَبَ عليهم الحضور للجمعة.
ويشترط لترك الجمعة أن ينصرفوا قبل دخول وقت الجمعة.
