الباب الخامس:
كتاب الصيام
تعريف الصوم.
الحكم التكليفي.
فضل الصيام.

الصيام المفروض.
أولاً: ما يجب فيه التتابع، ويشمل ما يلي.
ثانياً: ما لا يجب فيه التتابع، ويشمل ما يلي:
أ - قضاء رمضان، فمذهب جمهور الفقهاء عدم اشتراط التتابع فيه، لقوله تعالى: {فَعِدَّةٌ مِنْ أَيَّامٍ أُخَرَ} [البقرة:184]؛ فإنه ذكر الصيام مطلقاً عن التتابع([1] ) ، وقالوا بندب التتابع أو استحبابه للمسارعة إلى إسقاط الفرض([2] ) .
ب - الصيام في كفارة اليمين، وفي تتابعه خلاف، فذهب الحنفية وهو الأصح عند الحنابلة، وهو قول للشافعية: إلى وجوب التتابع؛ للقراءة الشاذة لابن مسعود فصيام ثلاثة أيام متتابعات([3] ) .
وذهب المالكية وقول للشافعية إلى جواز صومها متتابعة أو متفرقة([4] ) .
ج - صيام المتعة في الحج، وصيام كفارة الحلق، وصيام جزاء الصيد، وصيام النذر المطلق، وصيام اليمين المطلقة.
قال الله عز وجل في صيام المتعة: {فَمَنْ تَمَتَّعَ بِالْعُمْرَةِ إِلَى الْحَجِّ فَمَا اسْتَيْسَرَ مِنَ الْهَدْيِ فَمَنْ لَمْ يَجِدْ فَصِيَامُ ثَلاَثَةِ أَيَّامٍ فِي الْحَجِّ وَسَبْعَةٍ إِذَا رَجَعْتُمْ} [البقرة: 196].
وقال في كفارة الحلق: {وَلاَ تَحْلِقُوا رُءُوسَكُمْ حَتَّى يَبْلُغَ الْهَدْيُ مَحِلَّهُ فَمَنْ كَانَ مِنْكُمْ مَرِيضًا أَوْ بِهِ أَذًى مِنْ رَأْسِهِ فَفِدْيَةٌ مِنْ صِيَامٍ أَوْ صَدَقَةٍ أَوْ نُسُكٍ} [البقرة: 196].
وقال في جزاء الصيد: {أَوْ عَدْل ذَلِكَ صِيَامًا لِيَذُوقَ وَبَال أَمْرِهِ} [المائدة: 95].
فذكر الصيام في هذه الآيات مطلقاً عن شرط التتابع([5] ) .
