كتاب الصيام

شروط الصوم:
أهم شرط لصحة الصوم: النية.
وصفة النية أن تكون جازمة، معينة، مبيتة، مجددة، على ما يلي:
أولاً: الجزم.
ثانياً: التعيين.
ثالثاً: التبييت.
رابعاً: تجديد النية: ذهب جمهور الفقهاء إلى تجديد النية في كل يوم من رمضان، من الليل أو قبل الزوال - على الخلاف السابق في التبييت للنية - وذلك لكي يتميز الإمساك عبادة عن الإمساك عادة أو حِمْيَة (ريجيم، system)؛ ولأن كل يوم عبادةٌ مستقلةٌ، لا يرتبط بعضه ببعض، ولا يفسد بفساد بعض، ويتخللها ما ينافيها، وهو الليالي التي يحل فيها ما يحرم في النهار، فأشبهت القضاء؛ بخلاف الحج، وركعات الصلاة([1] ) .
وذهب المالكية ورواية عن أحمد: أنه تكفي نية واحدة عن الشهر كله في أوله؛ كالصلاة. وكذلك في كل صوم متتابع، ككفارة الصوم والظهار، ما لم يقطعه، أو يكن على حالة يجوز له الفطر فيها، فيلزمه استئناف النية، وذلك لارتباط بعضها ببعض، وعدم جواز التفريق، فكَفَتْ نيةٌ واحدةٌ، وإن كانت لا تبطل ببطلان بعضها؛ كالصلاة([2] ) .
