ما يفسد الصوم ويوجب القضاء والكفارة:
أولاً: الجماع عمداً:
ذهب جمهور الفقهاء إلى أن جماع الصائم في نهار رمضان، عامداً، مختاراً؛ بأن يلتقي الختانان، وتغيب الحشفة في أحد السبيلين مُفْطِر يوجب القضاء والكفارة، أنزل أو لم ينزل.
وعند الحنابلة: إذا جامع في نهار رمضان أنزل أم لا فعليه القضاء والكفارة، عامداً كان أو ساهياً، أو جاهلاً أو مخطئاً، مختاراً أو مكرَهاً([1] ) .
وهذا لحديث أبي هريرة رضي الله عنه قال: بينما نحن جلوس عند النبي صلى الله عليه وسلم إذ جاءه رجل،
فقال: يا رسول الله، هلكت،
قال: "مَا لَكَ"؟،
قال: وقعت على امرأتي وأنا صائم،
فقال رسول الله صلى الله عليه وسلم: "هَل تَجِدُ رَقَبَةً تُعْتِقُهَا"؟
قال: لا.
قال: "فَهَل تَسْتَطِيعُ أَنْ تَصُومَ شَهْرَيْنِ مُتَتَابِعَيْنِ"؟
قال: لا.
قال: "فَهَل تَجِدُ إِطْعَامَ سِتِّينَ مِسْكِينًا"؟
قال: لا.
قال: فمكث النبي صلى الله عليه وسلم، فبينا نحن على ذلك، أُتِيَ النبي صلى الله عليه وسلم بِعَرَقٍ فيها تمر( [2] ) ، قال: "أَيْنَ السَّائِل"؟
فقال: أنا،
قال: "خُذْ هَذَا؛ فَتَصَدَّقْ بِهِ"،
فقال الرجل: على أفقر مني يا رسول الله!، فوالله ما بين لاَبَتَيْهَا - يريد الحرتين - أهلُ بيت أفقر من أهل بيتي،
فضحك النبي صلى الله عليه وسلم حتى بدت أنيابه، ثم قال: "أَطْعِمْهُ أَهْلَكَ"([3] ) .
ولا خلاف في فساد صوم المرأة بالجماع؛ لأنه نوع من المفطرات، فاستوى فيه الرجل والمرأة. وإنما الخلاف في وجوب الكفارة عليها:
فمذهب أبي حنيفة ومالك وقول للشافعي، ورواية عن أحمد وهي المذهب عند الحنابلة، وجوب الكفارة عليها؛ لأنها هتكت صوم رمضان بالجماع فوجبت عليها كالرجل([4] ) .
وفي قول للشافعي وهو الأصح، ورواية أخرى عن أحمد: أنه لا كفارة عليها؛ لأن النبي صلى الله عليه وسلم أمر الواطئ في رمضان أن يعتق رقبة، ولم يأمر المرأة بشيء، مع علمه بوجود ذلك منها([5] ) .
